Terms of Service

These Terms of Service (“Terms”) govern your access to and use of fogrise-cigarette.com (the “Site”) and any purchase you make from xiangyandd (“we”, “us”, “our”). By using the Site or placing an order, you agree to these Terms.

1. Eligibility & Age

You may only use this Site and purchase products if you are of legal smoking age — at least 18, or the higher legal smoking age required in your country or region of residence. By using the Site you confirm that you meet this requirement. See our Age Verification Statement. We may refuse or cancel any order where age eligibility cannot be reasonably assured.

2. Products

We sell tobacco and related products (cigarettes, capsule/popper cigarettes, cigars and accessories, and e-cigarettes) for personal use by adults of legal smoking age. Products are not for resale. Product images are representative; packaging may vary by batch.

3. Orders & Minimum Order

A minimum order of 2 cartons/boxes applies. We may decline, limit or cancel any order at our discretion, including suspected resale, fraud, or shipping to a destination we cannot service.

4. Prices, Currencies, Taxes & Duties

Prices are shown publicly on the Site in US dollars (USD). Prices and availability may change without notice. Any import duties, taxes or fees levied by your destination country are your responsibility and are not included in the product price unless expressly stated.

5. Payment

We accept Zelle (US bank accounts), Interac e-Transfer (Canadian bank accounts), WeChat Pay, Alipay, credit/debit cards (via Stripe), PayPal and Payoneer. Zelle and Interac e-Transfer payments are sent by you from your own bank with your order number in the memo; an Interac e-Transfer is sent in Canadian dollars at the XE rate of the day you pay. Payment is processed by third-party providers; we do not store your full card details.

6. Shipping & Customs

We ship worldwide via EMS, UPS or FedEx, typically in 7–15 days, in discreet packaging with tracking. Cross-border tobacco can be held at customs. If your first parcel is seized, we will reship your order once, free of charge, upon receipt of the official seizure notice. This covers the first seizure only; a second seizure to the same destination is at your own risk. We do not provide refunds on tobacco; our remedy is reshipment. Full details: Shipping & Customs.

7. Returns, Wrong or Damaged Items

Because cigarettes are a consumable product that cannot be resold once shipped, we do not accept returns. If we send the wrong item, or your order is damaged in transit, contact us within 48 hours of delivery with clear photos and we will replace it free of charge. If a parcel is seized by customs, claim a free reshipment within 14 days of the seizure notice. Your statutory consumer rights in your jurisdiction remain unaffected.

8. VIP Loyalty

Loyalty benefits (e.g. 10+ cartons → 10% off; 50+ cartons → permanent 20% off; photo review → free shipping on the next order) are offered at our discretion and may change. Benefits are non-transferable and have no cash value.

9. Intellectual Property

All Site content (text, layout, graphics and original photography we create) is owned by or licensed to xiangyandd and may not be copied or reused without permission. Third-party brand names and trademarks remain the property of their respective owners and are used only to describe the products we sell.

10. Disclaimers & Limitation of Liability

We make no health claims about any product. Information on the Site is provided for general purposes and is not legal advice. You are responsible for complying with the tobacco import laws of your country or region. To the maximum extent permitted by law, xiangyandd is not liable for package seizures, duties, taxes, or losses arising from local regulations, nor for indirect or consequential damages. Nothing in these Terms limits liability that cannot be excluded by law.

11. Governing Law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law rules, and the courts of that jurisdiction will have exclusive jurisdiction, subject to any mandatory consumer protections in your place of residence.

12. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above reflects the latest version. Continued use of the Site after changes constitutes acceptance.
